Notice of Privacy Practices

THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOUR CHILD MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.

Therapy Clubhouse provides pediatric speech therapy and occupational therapy services in homes, via telehealth, and at our Westlake Village, California clinic. We are committed to protecting the privacy of the health information of the children and families we serve. As a covered entity under the Health Insurance Portability and Accountability Act (HIPAA) and California’s Confidentiality of Medical Information Act (CMIA), we are required by law to maintain the privacy of Protected Health Information (“PHI”), to provide you with this Notice of our legal duties and privacy practices, and to follow the terms of the Notice currently in effect.

Your Rights

With respect to your child’s health information, you (or another personal representative, such as a legal guardian) have the right to:

• Get a copy of the health record. You may ask to see or receive a paper or electronic copy of your child’s record. We will provide it, usually within 30 days, and may charge a reasonable, cost-based fee.
• Request a correction. You may ask us to amend information you believe is incorrect or incomplete. We may decline, but we will tell you why in writing within 60 days.
• Request confidential communications. You may ask us to contact you in a specific way (for example, only by mobile phone) or at a specific address. We will accommodate all reasonable requests.
• Ask us to limit what we use or share. If you pay for a service in full out of pocket, you may ask us not to share that information with your health plan for payment or operations purposes, and we will comply unless the law requires the disclosure.
• Get a list of those with whom we have shared information. You may request an accounting of certain disclosures made in the six years prior to your request.
• Get a copy of this Notice. You may request a paper copy at any time, even if you agreed to receive it electronically.
• Choose someone to act for you. A person with medical power of attorney or legal guardianship may exercise these rights on your child’s behalf.
• Be notified of a breach. We will notify you in writing if a breach of unsecured PHI affects your child’s information.
• File a complaint. You may file a complaint with us or with the U.S. Department of Health and Human Services Office for Civil Rights. We will never retaliate against you for filing a complaint.

How We May Use and Disclose Health Information

We may use or disclose PHI in the following ways without your written authorization, consistent with HIPAA and California law. Where California law is more protective, we follow the stricter requirement.

• Treatment. We use PHI to provide therapy services and may share it with other professionals involved in your child’s care, such as your child’s pediatrician or other treating providers.
• Payment. We may use and share PHI to bill and collect payment from you, your health plan, or other payers, including the Regional Center.
• Health care operations. We may use PHI for quality improvement, training, scheduling, and other administrative activities that support our practice.
• Care coordination with the Regional Center. When your child receives Early Start or other Regional Center-funded services, we share evaluation results, progress reports, and service information with the Regional Center as needed to authorize and coordinate services.
• Appointment reminders and service communications. We may contact you by phone, email, or text message to confirm appointments or share information related to your child’s care. Message and data rates may apply to texts; you may opt out at any time.
• Family and caregivers. We may share relevant information with a family member or caregiver involved in your child’s care, unless you ask us not to.
• Business associates. We may share PHI with vendors who perform services for us (such as billing or secure technology providers) under written agreements that require them to safeguard the information.
• As required by law. We disclose PHI when federal or state law requires it, including mandated reporting of suspected child abuse or neglect, responses to court orders, and public health reporting.
• Health and safety. We may share information when necessary to prevent a serious and imminent threat to the health or safety of your child, another person, or the public.
• Government oversight, workers’ compensation, and legal proceedings. We may disclose PHI to health oversight agencies, for workers’ compensation claims, or in response to lawful subpoenas and discovery requests when legal requirements are met.

Uses That Require Your Written Authorization

We will obtain your written authorization before using or disclosing PHI for marketing purposes, before any sale of PHI (we do not sell PHI), and for any use or disclosure not described in this Notice. School-related disclosures, for example, sharing reports with your child’s school or IEP team, are made only with your written permission unless otherwise allowed by law. You may revoke an authorization at any time in writing, except to the extent we have already relied on it.

California Protections

California’s Confidentiality of Medical Information Act (CMIA) provides protections that are in some cases stronger than HIPAA, and we comply with those stricter requirements. Personal information we collect through our website that is not PHI is described in our Privacy Policy.

Changes to This Notice

We may change this Notice at any time. The new Notice will apply to all PHI we maintain and will be posted on this page with an updated effective date. You may request a copy of the current Notice at any time.
